By downloading, installing, or using TalePatch ("the App," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and TalePatch.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

  • Posting updated Terms in the App
  • Updating the "Last Updated" date
  • Sending in-app notifications for significant changes

Your continued use of the App after changes constitutes acceptance of the modified Terms.

3. Description of Service

TalePatch is a mobile application that provides:

  • PDF and EPUB document import and reading
  • Text-to-speech (TTS) conversion using local and cloud-based engines
  • Offline audio downloads for premium users
  • Reading progress tracking and bookmarks
  • Synchronized text highlighting during audio playback
  • Cross-platform support (Android, iOS, Web)

3.1 Free vs. Premium Features

Free Version:

  • Basic document reading
  • Local system TTS voices
  • Reading progress tracking
  • Ad-supported

Premium Subscription:

  • Ad-free experience
  • Access to 48+ high-quality TTS voices
  • Offline audio downloads
  • Priority customer support
  • Advanced reading statistics

4. User Accounts

4.1 Account Registration

To use certain features, you must create an account by providing:

  • Valid email address
  • Secure password
  • Display name (optional)

Alternatively, you may sign in using Google Sign-In.

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of unauthorized access

We are not liable for losses resulting from unauthorized use of your account.

4.3 Account Termination

You may delete your account at any time through the App settings.

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse the service or other users
  • Fail to pay subscription fees

5. Acceptable Use Policy

You agree NOT to:

  • Upload, import, or share content you do not have rights to
  • Use the App for any illegal purposes
  • Infringe on copyrights, trademarks, or intellectual property rights
  • Import pornographic, defamatory, or hateful content
  • Share content that violates any law or regulation

5.2 Prohibited Activities

  • Attempt to hack, reverse engineer, or compromise the App
  • Use automated tools to scrape or extract data
  • Interfere with other users' enjoyment of the service
  • Circumvent any security measures or access controls
  • Resell or redistribute the App or its features
  • Use the App to spam or distribute malware

5.3 API Usage

  • Do not abuse the TTS API or attempt to exceed rate limits
  • Do not use TTS services for commercial purposes without authorization
  • Do not attempt to extract or replicate TTS voice models

6. Intellectual Property

6.1 App Content and Ownership

The App, including all software, designs, text, graphics, logos, and trademarks, is owned by TalePatch or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6.2 User Content

You retain all rights to content you import into the App (books, documents, etc.).

By using the App, you grant us a limited license to:

  • Process your content for TTS generation
  • Store your content locally on your device
  • Provide features like synchronization (if applicable)

We do NOT claim ownership of your content.

You are solely responsible for ensuring you have the legal right to import and convert any content to audio using the App. We do not monitor user content for copyright violations.

7. Subscriptions and Payments

7.1 Subscription Plans

Premium subscriptions are available on a:

  • Monthly basis
  • Yearly basis (discounted rate)

Prices are displayed in the App and may vary by region.

7.2 Billing

  • Subscriptions are billed through Google Play (Android) or Apple App Store (iOS)
  • Payment is charged at the time of purchase
  • Auto-renewal occurs unless cancelled at least 24 hours before the renewal date

7.3 Free Trials

We may offer free trial periods for new subscribers. You will not be charged during the trial. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

7.4 Cancellation and Refunds

  • You may cancel your subscription anytime through your Google Play or Apple App Store account
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused time
  • Refund requests must be made through Google Play or Apple App Store

7.5 Price Changes

We reserve the right to change subscription prices with 30 days' advance notice. Price changes apply to new subscriptions or renewals after the notice period.

7.6 Promotional Offers

Promotional offers are subject to specific terms and may be limited to new subscribers or specific periods.

8. Third-Party Services

The App integrates with third-party services:

8.1 Third-Party TTS Engines

  • Replicate (Kokoro TTS) - for high-quality cloud voices
  • System TTS engines - provided by your device

8.2 Authentication

  • Google Sign-In
  • Supabase authentication

8.3 Advertising

  • Google AdMob (free version)

You agree to abide by the terms and privacy policies of these third-party services.

9. Data Privacy

Your privacy is important to us. Please review our [Privacy Policy](PRIVACY_POLICY.md) to understand how we collect, use, and protect your information.

Key points:

  • Books you import are stored LOCALLY on your device
  • We do not have access to your imported content
  • Only text you actively listen to is sent to TTS services
  • Authentication data is stored securely

10. Disclaimers and Warranties

10.1 "AS IS" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability
  • Uninterrupted or error-free operation

10.2 No Guarantee of Accuracy

We do not guarantee that:

  • TTS audio will be accurate or error-free
  • Text extraction from PDFs/EPUBs will be perfect
  • The App will meet your specific requirements
  • Service will be uninterrupted or secure

10.3 Third-Party Content

We are not responsible for:

  • Content you import into the App
  • Accuracy of third-party TTS engines
  • Availability of third-party services

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11.1 No Indirect Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data
  • Loss of use
  • Cost of substitute services
  • Business interruption

11.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF:

  • The amount you paid us in the 12 months before the claim, OR
  • $100 USD

11.3 Exceptions

Some jurisdictions do not allow limitation of liability, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless TalePatch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your use of the App
  • Content you import or share

13. Termination

13.1 By You

You may stop using the App and delete your account at any time.

13.2 By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Fail to pay subscription fees
  • For any other reason with or without notice

13.3 Effect of Termination

Upon termination:

  • Your right to use the App ends immediately
  • Your account data may be deleted (subject to our Privacy Policy)
  • You remain liable for any outstanding obligations
  • Provisions that should survive termination will remain in effect

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, etc.).

15.6 Language

These Terms are provided in English. Translated versions are for convenience only. In case of conflict, the English version prevails.

16. Accessibility

We strive to make the App accessible to users with disabilities. If you experience accessibility issues, please contact us at accessibility@talepatch.com.

17. Children's Use

The App is not intended for children under 13 years of age. If you are under 13, do not use the App or provide any personal information.

Parents or guardians who discover their child has provided information should contact us for deletion.

18. Export Controls

The App may be subject to export control laws. You agree to comply with all applicable export and import laws.

19. Updates and Maintenance

We may:

  • Release updates, patches, or new versions
  • Perform scheduled or emergency maintenance
  • Modify or discontinue features

We are not obligated to provide updates or maintain backward compatibility.
